Refund policy
This return policy (hereinafter, the “Return Policy”) governs the manner in which customers may return products purchased on the store.kobesportswear.com website (together with its sub-domains, the “Website”).
By accessing and browsing the Website, you accept, without limitation or qualification, the terms and conditions set out below, all other policies incorporated by reference herein, and all applicable laws.
The products purchased on the Website are sold directly by Kobe Sportswear Inc. (hereinafter “Kobe Sportswear,” the “Vendor,” “We,” or “Us”) Canada.
1. Procedures for exercising the right of return
Kobe Sportswear’s goal is to guarantee each customer’s full satisfaction. If, for any reason, you are not satisfied with your order, you may exercise your right to return the purchased products.
You must inform Us of your intention to return within twenty (20) calendar days of the date on which you received the product (or, in the case of multiple items, within twenty (20) days of receipt of each individual product) by completing the online Return Form available under Order Management / Returns in your Website account.
1.1 Shipping your return
Returned products must be shipped from the same country to which they were delivered within fourteen (14) calendar days of submitting the Return Form.
We do not provide pre-paid return labels.
You are responsible for arranging and pre-paying for return shipping, and you bear the risk of loss or damage in transit.
We strongly recommend using a traceable, insured service and retaining proof of dispatch.
2. Terms and conditions of return
Your return will be deemed properly exercised once all of the following requirements are met:
You submitted the Return Form within twenty (20) days of receiving the product(s).
The products are new, undamaged, unworn, and unwashed, save for trying them on to assess fit and characteristics.
All identification tags, labels, and any disposable seals remain attached.
The products are returned in their original packaging, if possible and intact, together with the delivery receipt enclosed in the original parcel.
The parcel is dispatched within fourteen (14) days of submitting the Return Form.
Once all conditions are satisfied, We will refund the full purchase price of the returned products (see section 3).
2.1 Non-acceptance of returns
If the returned products do not meet the above conditions, We will notify you by e-mail. You may elect to have the products re-shipped to you at your expense. If you refuse re-delivery, the products will be deemed abandoned, and We may retain both the products and the purchase price.
2.2 Exceptions
The right of return does not apply to:
Sealed items that are not suitable for return for health or hygiene reasons once unsealed;
Products customised or made to your specifications;
Products that, after delivery, are inseparably mixed with other items;
Digital goods or services once download or streaming has begun.
3. Refund terms and procedures
When we have received and inspected the returned products and confirmed compliance with this Return Policy, you will receive an e-mail confirming acceptance of the return. Refunds will be issued to the original form of payment within fourteen (14) calendar days of (i) our receipt of the products or (ii) your proof of dispatch, whichever occurs first.
Original outbound shipping charges, gift-wrapping fees, duties, taxes, and any other surcharges selected at checkout are non-refundable.
We reserve the right to deduct from your refund any diminution in the value of the products resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
4. Exchange options
Kobe Sportswear does not process direct product exchanges. If you wish to obtain a different size, colour, or item, please follow the return procedure above and then place a new order.
As a courtesy, once your return is accepted We will e-mail you a single-use free-shipping code for your next order placed within thirty (30) days. This code applies to standard shipping within Canada and the continental U.S. only.
5. GENERAL
5.1 Entire agreement
This Return Policy, together with our Terms of Sale, Terms of Use, Privacy Policy, Cookie Policy, and all other policies referenced herein, constitutes the entire agreement between you and Kobe Sportswear with respect to returns and supersedes all prior proposals, communications, and agreements.
5.2 Severability
If any provision of this Return Policy is deemed invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.
5.3 Waiver
No failure or delay by either party in exercising any right under this Return Policy operates as a waiver of that right. Any waiver must be in writing and signed by the waiving party.
5.4 Third-party rights
This Return Policy is between Kobe Sportswear and the customer; no third party shall have any right to enforce any term herein.
5.5 Language
English is the sole authoritative language of this Return Policy and all related communications.
